Questa è una fotografia il cui paese di origine è l'Italia e che è nel pubblico dominio in Italia poiché il suo copyright è scaduto. Secondo la legge 22 aprile 1941 n. 633 e successive modificazioni, «il diritto esclusivo sulle fotografie dura vent'anni dalla produzione della fotografia» (articolo 92) ovvero tali fotografie divengono di pubblico dominio a partire dall'inizio dell'anno solare seguente il termine dei vent'anni. In accordo al testo di legge, tali fotografie sono: «immagini di persone o di aspetti, elementi o fatti della vita naturale e sociale, ottenute col processo fotografico o con processo analogo, comprese le riproduzioni di opere dell'arte figurativa e i fotogrammi delle pellicole cinematografiche. Non sono comprese le fotografie di scritti, documenti, carte di affari, oggetti materiali, disegni tecnici e prodotti simili» (articolo 87).
Diventano invece di pubblico dominio al «termine del settantesimo anno dopo la morte dell'autore» (art. 32bis) le «opere dell'ingegno di carattere creativo» (art. 1), comprese «le opere fotografiche e quelle espresse con procedimento analogo a quello della fotografia sempre che non si tratti di semplice fotografia» di cui sopra (art. 2, c. 7).
Questa norma potrebbe non valere in paesi che non applicano la regola della durata più breve a opere italiane. In particolare, questa è nel pubblico dominio negli Stati Uniti solo se:
non è protetta da copyright a seguito di una registrazione di copyright (vedi Commons:Copyright tags#United States per la maggior parte dei casi) e
è stata creata prima del 1976 e pubblicata prima del 1978 — quindi non era protetta da copyright in Italia alla data del ripristino URAA (1 gennaio 1996) (17 U.S.C.§ 104A). Se è così, per favore aggiungi {{PD-1996}} in aggiunta a questo tag di copyright. Se l'immagine è stata creata nel 1976 o dopo, per favore aggiungi {{Not-PD-US-URAA}}.
Quest'opera è nel pubblico dominio negli Stati Uniti perché rispetta tre requisiti:
pubblicata per la prima volta fuori dagli Stati Uniti (e non pubblicata negli Stati Uniti entro 30 giorni),
pubblicata per la prima volta prima del 1 marzo 1989 senza avviso di copyright o prima del 1964 senza rinnovo del copyright o prima che il paese di origine stabilisse trattati sul copyright con gli Stati Uniti,

Per U.S. Circ. 38a, the following countries are not participants in the Berne Convention or Universal Copyright Convention and there is no presidential proclamation restoring U.S. copyright protection to works of these countries on the basis of reciprocal treatment of the works of U.S. nationals or domiciliaries:
East Timor, Eritrea, Ethiopia, Iran, Iraq, Marshall Islands, Palau, Somalia, Somaliland, and South Sudan.
As such, works published by citizens of these countries in these countries are usually not subject to copyright protection outside of these countries. Hence, such works may be in the public domain in most other countries worldwide.
However:
Works published in these countries by citizens or permanent residents of other countries that are signatories to the Berne Convention or any other treaty on copyright will still be protected in their home country and internationally as well as locally by local copyright law (if it exists).
Similarly, works published outside of these countries within 30 days of publication within these countries will also usually be subject to protection in the foreign country of publication. When works are subject to copyright outside of these countries, the term of such copyright protection may exceed the term of copyright inside them.
Unpublished works from these countries may be fully copyrighted.
A work from one of these countries may become copyrighted in the United States under the URAA if the work's home country enters a copyright treaty or agreement with the United States and the work is still under copyright in its home country.
Somalia inherited the UK Copyright Act 1911, but replaced it with Law No. 66 of 7 September 1977. The new law was based on the 1976 Tunis Model Copyright Law and gave a general term of 30 p.m.a. for works. However, it also had a highly prescriptive registration requirement to obtain copyright protection, and no copyright registration office currently exists (if it ever did).Note: As per Commons policy, this tag alone is not sufficient. You also need to supply a tag that describes why the work is public domain in its country of origin.
