De facto is Latijn voor "in feite" of "in de praktijk".

Het tegenovergestelde van de facto is de jure of "formeel", dat op een officiële regeling zoals een wet of een overeenkomst betrekking heeft. De facto en de jure worden vooral tegelijk gebruikt, wanneer de twee in de praktijk niet overeenkomen, dus als een formele regeling anders is of ontbreekt.
